Sgt. Thomas Hart's Will

Probate Records, Hartford District, v. XII, p. 153-4-5-6. HART, Thomas, Sergt., Farmington. Invt. £707-01-01. Taken 2 May, 1728, by John Hart, Sen., Joseph Judd and Isaac Cowles. Will dated 28 December, 1727.

I, Sergt. Thomas Hart, of the Town of Farmingtown, being infirm, impotent and weak in body, do make this my last will and testament: Item. Unto Elizabeth Hart, my beloved wife, I give during her natural life the use of 1-2 of my now dwelling house and 1-3 part of my barn, and 1-3 of every piece or parcell of my land hereafter in this instrument given to my sons; also I give her, to be at her own dispose forever, 1-3 part of all my personal estate. Unto my son Stephen Hart I give 1-5 part of all my right which I have in common in the reserved land; also I give unto him of my personal estate 5 shillings. Item. Unto my son Thomas Hart, besides what I have already given him, 5 shillings. Unto my son Joseph Hart, besides what I have already given him, I give to him and his heirs forever 1-5 part of all my right which I have in common within the reserved land. I also give unto him 5 shillings. To my two sons, Samuel Hart and Jeams Hart, to them I give and bequeath 2-3 parts for quantity and quality of that tract of land within the common fence by my house and northerly from it, which 2-3 parts is to be the northerly part of sd. tract of land, to be equally divided between them. Also I give unto them 2-3 parts of that tract of pasture land which I have on the east side of the common fence at Ware Swamp. I give unto them 2-3 parts of all my land at a place called The Old Farm. Also I give unto them, to be equally divided between them, my lott lately brought under improvement lying in that division of land in the north of the reserved lands on the east side of the river. Also I give unto each of them 1-5 of all my right which I have in common within the reserved land. Also I give unto them, in equal proportion between them, all the residue of my land or rights to lands, wheresoever and whatsoever it be, that shall not otherwise be found mentioned in this my will. Item. Unto my son William Hart I give my now dwelling house and barn; 1-2 part of the house in present possession and the other half in reversion; 2-3 parts of the barn in present possession and 1-3 part in reversion; also that lott in which sd. barn stands; also that southerly third part for quantity and quality of that tract of pasture land which I have on the east side of the common fence at Ware Swamp. Also I give unto him 1-3 part of all my land in the common field at a place called The Old Farm, and also 1-5 part of all my right which I have in common within the reserved land. I expect of my son William that he be careful of and kind to his mother. Item. Unto my daughter Elizabeth Hart I give and bequeath all the residue and remainder of my personal estate not before disposed of in this my will, whatsoever and wheresoever it be. And in case that this remainder of my estate do not prove to make up to her the value of £60, then my will is that my three youngest sons, vizt., Samuel, Jeams and William, shall pay to her in equal proportion so much as to make her part £60. I appoint my wife Elizabeth Hart and my son Samuel Hart executors.

Court Record, Page 191 -- 7 May, 1728: Will exhibited by Elizabeth Hart and Samuel Hart, executors. Proven. This Court appoint Mrs. Elizabeth Hart to be guardian to her son William Hart, 18 years of age. Recog., £100.

Page 59 (Vol. XVII) 1st April, 1755: Hezekiah Winchell, of Farmington, showing to this Court that he has a right in lands that lie in common or joynt tenancy with the heirs of Thomas Hart, late of Farmington, deceased, and the rest of the surviving partners and tenants in common in sd. Farmington, and desires freeholders may be appointed to assist in dividing sd. land: Whereupon this Court appoint Samuel Thompson, Samuel Lankton and Joseph Porter of Farmington, to assist in dividing sd. land lying in common as aforesd.
