I. Non-Sexual "Hurting" Allegations:

• S.W. told her mother that a blond man with glasses would sit S.W, on his lap and introduce a scary robot to her. (Interviews, p.326)
• She told mother about a "Mr. Gatt" (more of "Mr. Gatt" below) "whose mother always spanks him." (Interviews, p.326)
• Tooky put a knife on S.W.'s arm "and threatened to cut her up if she didn't get out." (Interviews, p.327)
• S.W. told mother that her bum hurts "because someone put a knife in her behind." (Interviews, p.327)

• S.W. told mother that Tooky tried to cut her with a knife. (Vol. 33, pp.103-105)
• S.W. told mother that the robot bit her on the arm. (Grand Jury, 1/16/85, p.115)
• Tooky is a bad man, S.W. told mother, because he "sticks knives up kids' bums." (Grand Jury, 1/16/85, p.120)
• S.W. told Susan Kelley that Tooky "placed scissors up her bum." Tooky said, "I want to cut your bum" as he did this. (Grand Jury, 1/16/85, p.22)
• At trial, the mother says that S.W. said that Tooky put a knife up S.W.'s bum. (Vol. 33, pp.140-142)
• S.W. told mother that "Tooky was sorry for chopping me into little pieces." (Vol. 33, p.164)
• At trial, S.W. testified that Tooky bit her on the arm and "stuck a knife in her bum," (Vol. 33, pp.61-62)
• The robot at Fells Acres Day School "threw me around in circles" and bit S.W. on the arm. (Vol. 33, p.65)
• "Mr. Gatt," whose mother always spanks him (Interviews, p.326). also stuck a knife up S.W.'s bum. (Vol. 31, p.79). (This is at trial.)
• The robot was silver and had lights on it. It moved around on wheels. It had blue, green and yellow on it. It talked in robot language, like R2D2 in Star Wars. (Vol. 33, pp.80-82)
• Tooky cut S.W. on the wrist with a knife. Miss Cheryl gave her a Band-Aid. (Vol. 33, p.85)
• S.W. indicated at trial that the size of the knife that Tooky put in her bum was 12 inches long and 3-4 inches wide. (Vol. 33, pp.88-89,98).
• The knife got stuck in her bum. She couldn't get it out. She screamed and Miss Anne Marie heard her. Tooky explained that the knife was stuck in S.W. (Vol. 33, pp.94-96)
• None of the children heard her scream when the knife got stuck in her bum. But Miss Anne Marie and Miss Lisa warned Tooky, "Don't do that again." (Vol. 33, pp.95-97)

• S.W. never talked to the other kids about the robot. (Vol. 33, p.84)

• S.W. said that "a camera was used at various times in the school." (Interviews, p.323)
• "S.W. has also told her mother about a camera and that she had her picture taken with Brian."

• S.W. saw a "bad clown" at Fells Acres Day School. (Vol. 33, p.62)

• The bad clown didn't do anything bad to her, and never touched any parts of her body. (Vol. 33, pp.62-63)

• Tooky took S.W. to the "magic room" and tried to cut her with a knife. (Vol. 33, pp.104-105)
• S.W. told Susan Kelley that Tooky brought her to the "secret room" and placed scissors up her bum. (Grand Jury, 1/16/85, p.22)

VI. Seeing Nude Adults: No allegations in the record.

VII. Allegations of sexual activity:

• S.W. told mother that Miss Cheryl would kiss S.W.'s face long and hard. (Grand Jury, 1/16/85, pp.117-118)

• Susan Kelley can't recall any other "sexual" allegations by S.W. (Grand Jury, 1/16/85, p.23)
• Although Tooky put a finger up her bum, S.W. testified that Tooky did not touch her in any other place. (Vol. 33, p.61)

• S.W. said that Tooky had said that he was going to chop mommy and daddy up into little pieces. (Vol. 33, p.22)
• At trial, S.W. testified that Tooky threatened to cut her parents "into pieces" if she told them about the knife being stuck in her bum. (Vol. 33, p.64)

• Several times S.W. told her mother that a big bear and a robot, both at Fells Acres Day School, were going to get S.W. (Interviews, p.322)
• The Commonwealth's medical expert. Dr. Jean Emans, testified that the hymeneal bump she found on S.W. in December of 1984 could have been caused by a knife:

• The court ordered that this testimony be stricken. (Vol. 40, pp.6-7)

• S.W.'s teacher, Michelle Hatch, testified that she had never seen any robots or bears or walking lobsters at Fells Acres Day School. An outside clown named "Hicko" sometimes came to Fells Acres Day School to entertain the children and do magic tricks. And, she never saw any child run away from Gerald Amirault. (Vol. 43, p.148)
• On cross-examination, S.W. was asked if she remembered a big bear at Fells Acres Day School. S.W. replied, "No, there's no bears around that nice school." (Vol. 33, p.78; emphasis added).
