October 2003 and Phase 3, Reality or Fiction?



Local Businesses of Phase 3 above the law! Local Government Powerless!

Nearly one and a half years after Phases One and Two were completed Phase 3 remains uncertain.

What is certain, is that the City of Trenton allows these businesses to thumb their noses at the Law and Tax Payers!

Here are some facts:

In the process of finalizing the buy-out and turing over property in this mitigation. Every owner/occupant signed an affidavit from the Government that declared the property acquired can not and will never be used for residential,or commercial usage by anyone!

March 14, 2002 demolition began of Phase 1 and was completed March 21, 2002. On May 15, 2002 demolition began on Phase 2 and was completed by May 30, 2002. As early as June of 2002 the illegal usage of the property began. The people who are guilty of violating the law are free of persecution.

One business uses mitigation property as a parking lot for employee parking! The other business uses mitigation property as an extension of their Used Vehicle showroom. On any given business day one can ride down Mulberry Street and see vehicles parked upon the street and on mitigation property without license plates. According to the City of Trenton, any vehicle parked upon public property without license plates is considered abandoned and is subjected to immediate removal to the impound yards. Yet day in and day out these people do as they please.

One business has had the gall to deny the Environmental Protection Agency on their property to take soil samples. The EPA is powerless to even determine the amount of contamination done by this business. The Used Car Dealership uses public land as an extension of their business without any worry.

What has MSA done?

The Co-chairman has brought this matter to the attention of the President of City Council, and to the Department head in charge of the demolition process requesting a fence be erected to keep business from using this land. MSA has sent photos too City Council President, the Trenton Police, and the State Police showing proof positive that the law was being broken. Result? NOTHING!

MSA urges everyone to demand the State of New Jersey and the City of Trenton enforce the law!
