Will of Nicholas Washburn (Jan 23, 1815- Apr 1, 1887)
Son of Calvin Washburn and Merrica Miller. Nicholas was born in Gallatin, Columbia County. Family moved to Providence, Luzerne Co., PA became Hyde Park, Luzerne County, PA, later became Scranton, Lackawanna Co., PA. Nicholas buried in Forest Hill Cemetery in Lackawanna County, PA.
WILL OF NICHOLAS WASHBURN. His will is indexed for Lackawanna County Courthouse as estate# 1236. Obtained from Lackawanna County Register of Wills, 200 N. Washington Ave., Scranton, PA 18503. It reads as follows: Registrar's Office, Lackawanna County. ss: Now, to wit, the ninth day of May A.D. 1887 personally came Frank Washburn and on his solemn oath did depose, declare and say, that he believe that Nicholas Washburn died without a will. That he will, as administrator well and truly administer the goods and chattels, rights, and credits of said deceased, according to law. That he will immediately publish for creditors, once a week for six successive weeks, and render into the Register's Office, within thirty days from this date, a just and true inventory and appraisement of the personal estate of said deceased, and additional inventories when necessary. Also a just and true account, calculation and reckoning of his said administration in one year from this date, or when thereunto legally required. That he will diligently and faithfully regard and well and truly comply with the provisions of law relating to collateral inheritances. And also that he died leaving a widow, Maria, surviving him; and four children, to wit, Jonas, Frank, Douglas, and William. And also that the whole of the goods, chattels, rights, and credits of the estate and effects, for or in respect of which Letters of administration are applied for which he died possessed of, in the aggregate, do not in value exceed the sum of _____ (no amount listed) dollars, to the best of his knowledge and belief. Sworn and subscribed before me the day and year aforesaid, and granted unto Frank Washburn (his signature). Lackawanna County, ss: I, E. A. Atherton, Register, &c., do certify that the above oath was taken and subscribed before me, the day and year aforesaid. Witness my hand and the seal of the Register's Office at Scranton this ___ day of ___ A.D. 188_ (no dates filled in). Separate page: E.A. Atherton - Esq.register for the probate of wills and granting letters of administration in and for the County of Lackawanna. Whereas my late husband Nicholas Washburn died intestate whereby the right of the administration of the estate did devolve upon me: Now know, that for divers good causes moving me, I have released, and hereby do release all my right and title to the administration of the said estate.
